Each appointment time is reserved exclusively for you and our artists allocate the scheduled treatment time specifically to your booking. All booking deposits are non-refundable. Where an appointment is cancelled or rescheduled with at least 48 hours’ notice, the deposit will be retained as a credit on the client’s account or transferred to the rescheduled appointment in accordance with our cancellation and rescheduling policy. Credits retained in this way remain available for 12 months from the date of the original appointment. The booking deposit will be applied toward the total cost of the booked service on the day of your appointment.By completing a booking, you confirm that:• the information supplied during the booking and consultation process is accurate to the best of your knowledge;• you have reviewed the service description and applicable pricing;• you have had the opportunity to review these Terms of Service; and• you understand the applicable cancellation, rescheduling and no-show conditions.Miller Lane Aesthetics may contact you where additional information is required before determining whether a treatment can safely or appropriately proceed.
CANCELLATIONS, RESCHEDULING, NO-SHOWS & LATENESSAppointment times are reserved especially for you.Late cancellations and missed appointments can result in significant loss to an appointment-based business because the reserved treatment time may be unable to be reallocated at short notice. Our cancellation policy is therefore applied strictly and consistently.→ Cancellations more than 48 hours before the appointmentThe booking deposit is retained as a credit on the client's file toward a future appointment.Credits held in this way remain available for 12 months from the date of the original appointment.→ Cancellations between 24 and 48 hours before the appointmentThe booking deposit is forfeited.→ Cancellations less than 24 hours before the appointmentThe full service fee applies and will be charged to the card securely held on file.Any booking deposit already paid is applied toward this amount.→ Non-attendance without noticeWhere a client does not attend a scheduled appointment and has not cancelled the appointment beforehand, the full service fee applies and will be charged to the card securely held on file.Any booking deposit already paid is applied toward this amount.→ ReschedulingAppointments may be rescheduled without forfeiting the booking deposit where the change is made at least 48 hours before the scheduled appointment time. The existing booking deposit will automatically transfer across to the new rescheduled appointment.→ Late arrivalsClients arriving more than 15 minutes after their scheduled appointment time may be unable to receive their booked service.Depending on the treatment, remaining appointment time and operational requirements, Miller Lane Aesthetics may:• modify the booked service;• perform only the component of the service that can safely be completed within the remaining appointment time; or• treat the appointment as a late cancellation.Where the appointment cannot reasonably proceed because of the client's late arrival, the applicable cancellation fee may be charged.Card-on-file paymentsCard details are captured securely at the time of online booking and are stored by our payment provider. They are not held by Miller Lane Aesthetics.By completing a booking, you authorise Miller Lane Aesthetics to charge any applicable cancellation or non-attendance fee to the card held securely on file through Timely or our payment provider.Business-initiated cancellationsIf Miller Lane Aesthetics needs to cancel an appointment, we will make reasonable efforts to offer an alternative appointment.Where a suitable alternative cannot be arranged, any amount paid toward a service that we are unable to provide will be refunded or transferred at the client's election, as required by law.Cancellation fees generallyCancellation and non-attendance fees are intended to compensate Miller Lane Aesthetics for reserved artist time and losses associated with late cancellation or non-attendance and are not intended to operate as a penalty.Miller Lane Aesthetics may reduce or waive an applicable fee where required by law or where we consider it appropriate having regard to the circumstances.Any discretion exercised on one occasion does not create an entitlement to the same exception on another occasion.
CONSULTATION FORMS & CLIENT RESPONSIBILITYClients must complete all required consultation information accurately and honestly. The consultation process is an important part of determining treatment suitability and safety.Clients must disclose any information reasonably relevant to the proposed treatment, including where applicable:• allergies and known sensitivities;• medications;• pregnancy or breastfeeding;• medical or skin conditions;• eye conditions or recent eye procedures;• previous reactions to beauty products or treatments;• recent cosmetic, injectable, laser or other procedures;• prescription skincare;• retinoids;• exfoliating acids or other active skincare;• recent chemical treatments to the brow or lash hair; and• any other information requested during consultation.Clients must advise Miller Lane Aesthetics of relevant changes before each appointment, even where the information was supplied at a previous appointment.Where relevant information is incomplete, inaccurate or withheld, Miller Lane Aesthetics may be unable to properly assess treatment suitability. We may decline, postpone or modify a treatment where we reasonably consider this necessary for client safety, treatment integrity or hair or skin health.HEALTH & SAFETYClient safety and treatment suitability take priority over completion of a booked service.Miller Lane Aesthetics may decline, modify, postpone or discontinue a treatment where we reasonably believe that:• the treatment may be unsafe;• there is a contraindication;• the skin or hair is not suitable for treatment;• the client's natural lashes or brows are too compromised for additional processing;• required consultation information has not been provided;• further treatment may increase the risk of damage or irritation; or• proceeding would otherwise be professionally inappropriate.Certain treatments may require patch testing or other preliminary assessment.Where a treatment cannot proceed on the dayWhere a treatment cannot proceed because of a health matter or contraindication disclosed to us in advance, the booking deposit will be transferred to a new booking date and time as discussed.Where a treatment cannot proceed because relevant information was not disclosed before the appointment, we will always do our best to alter the appointment and perform what we safely can on the day. However, if we are unable to proceed with anything on the day, the appointment will be treated as a late cancellation and the booking deposit will be forfeited.CLIENTS UNDER 18Clients under 18 years of age may only be treated with the consent of a parent or guardian. The parent or guardian must complete the required consultation information and attend the appointment. Some treatments are not suitable for, or available to, clients under 18. This will be determined during consultation.
BROW TREATMENT AFTERCAREBrow results, and particularly treatments designed to create temporary colour or staining on the skin, are significantly influenced by individual skin characteristics and aftercare. For the first 48 hours following your brow treatment, the treated brow area must remain completely dry and free from products, excessive heat, steam and unnecessary friction. This means a full 48-hour period from the completion of your appointment.Unless otherwise specifically advised by your artist, during this 48-hour period clients must avoid:• water;• directly washing or wetting the brows;• excessive heat;• steam;• excessive perspiration;• swimming;• saunas;• steam rooms;• rubbing;• scrubbing;• exfoliation;• cleansers, skincare, makeup or other products applied directly through or immediately around the treated brow area; and• unnecessary friction.Failure to follow the prescribed 48-hour aftercare may significantly affect colour retention, skin staining and the longevity of your treatment and will be taken into account when assessing any concern regarding premature fading or treatment results.Showering and washing your hairWe strongly recommend avoiding hair washing during the first 48 hours following your brow treatment. If showering or hair washing is unavoidable, the brow area must remain completely dry and should not come into contact with water, steam, shampoo, conditioner, facial cleanser or other products.Particular care should be taken as water and products can easily run across the brow area even where the brows are not deliberately being washed.Products around the brow areaDuring the prescribed 48-hour aftercare period, clients must avoid applying products directly through or immediately around the treated brow area, including:• cleansers;• oil-based cleansers;• moisturisers;• serums;• facial oils;• exfoliating products;• active skincare;• makeup;• makeup removers; and• SPF applied directly through the treated brow area.Where SPF cannot be applied directly over the treated area during the initial aftercare period, clients should use appropriate alternative sun-protection measures such as avoiding direct sun exposure, seeking shade or wearing a hat.Following the initial 48-hour aftercare period, frequent exposure to cleansing, skincare, oils, exfoliation, makeup removal, water, heat, steam and perspiration may still accelerate the fading of temporary brow skin staining.HYBRID BROW DYE — SKIN STAIN & LONGEVITYHybrid brow dye is designed to temporarily colour the natural brow hair while also creating a temporary surface-level stain on the skin.It is not cosmetic tattooing, permanent makeup or a permanent brow treatment. The skin stain is temporary and progressively fades as the skin naturally renews itself and is exposed to natural skin oils, cleansing, skincare, water and normal daily activity.Because the stain sits temporarily at the surface of the skin, its longevity is inherently variable and external exposure may accelerate fading. This is particularly important during the initial 48-hour aftercare period.Factors capable of reducing skin-stain longevity include:• water;• heat;• steam;• perspiration;• swimming;• cleansing;• oil-based cleansing products;• skincare;• moisturisers;• serums;• oils;• exfoliation;• active skincare;• makeup• makeup remover;• SPF applied directly over the area;• rubbing and friction;• high natural oil production; and• natural skin cell turnover.Where stated on our service menu, Precision Hybrid Dye may provide colour for up to 7 days on the skin and up to 4 weeks on the brow hair. These periods describe the maximum expected longevity of the treatment and are not guaranteed minimum wear periods.Skin-stain retention may be significantly shorter for some clients depending on individual skin characteristics, lifestyle, skincare and aftercare.Colour deposited onto the natural brow hair generally remains longer than the temporary skin stain; however, hair retention may also vary according to hair type, condition, previous chemical processing, cleansing, skincare and individual response to the product.Individual results will vary.BROW LAMINATION & CHEMICALLY PROCESSED BROW HAIRBrow lamination temporarily alters the positioning and behaviour of the natural brow hair using a chemical processing system. Results vary depending on factors including:• natural hair texture;• direction of growth;• hair density;• hair condition;• previous chemical processing;• growth cycle;• home care; and• individual response to the treatment.Clients must follow all aftercare provided by their artist.Chemically processed brow hair should be handled gently and appropriately conditioned as advised.Clients should avoid unnecessary rubbing, pulling, repeated brushing or other handling that may place additional stress on chemically processed brow hair.Additional chemical processing cannot necessarily be safely performed immediately where a client requests an adjustment, correction or further treatment.Miller Lane Aesthetics may decline or postpone further processing where we consider the condition of the brow hair or surrounding skin makes further treatment inappropriate or where additional processing may compromise the health or integrity of the natural brow hair.
LASH TREATMENT RESULTSLash treatments are performed on the client's natural lashes. The result and longevity of lash lifting and tinting therefore depend on the individual characteristics and condition of the natural lash hair.Factors that may affect lash results include:• natural lash length;• thickness;• texture;• direction of growth;• porosity;• natural growth cycle;• previous lash treatments;• previous chemical processing;• lash condition;• hormones;• medications;• exposure to heat and steam;• products used around the eyes;• mechanical friction; and• adherence to aftercare.Lash lifting and tinting are temporary treatments. As the natural lash cycle progresses, treated lashes will gradually shed and be replaced by new untreated lashes.Any advertised longevity is therefore an expected or maximum period rather than a guaranteed minimum for each individual client.LASH LIFT & LASH TINT AFTERCAREUnless your artist provides different treatment-specific instructions, particular care should be taken during the first 24 hours following a lash lift and/or lash tint.During this period, avoid:• directly wetting or soaking the lashes;• excessive steam;• saunas and steam rooms;• swimming;• excessive heat;• excessive perspiration;• rubbing or pulling the lashes;• sleeping with the lashes heavily compressed against the pillow;• mascara;• eye makeup applied directly through the lashes;• harsh eye makeup removers; and• excessive oil-based product use directly through the lashes.Clients should take care when showering and washing their hair to minimise direct water and steam exposure to the lashes during the prescribed aftercare period.Do not use mechanical lash curlers following a lash lift unless specifically advised otherwise by your artist. After the initial aftercare period, lashes should continue to be treated gently.Repeated rubbing, pulling, excessive heat, harsh cleansing and other mechanical or environmental exposure may affect the appearance and longevity of the treatment.Where your artist gives different aftercare instructions based on the specific lash system or treatment performed, those treatment-specific instructions must be followed instead.LASH LIFT ADJUSTMENTS & REPROCESSINGA lash lift is a chemical treatment and cannot necessarily be safely repeated immediately.Where a client reports a concern, Miller Lane Aesthetics will assess:• the lash result;• the condition and integrity of the natural lashes;• the original processing undertaken;• the photographs provided;• the aftercare followed; and• whether additional chemical processing can be safely performed.Even where an adjustment is considered appropriate, Miller Lane Aesthetics may determine that the lashes require a recovery period before further processing. The health and integrity of the natural lashes take priority over immediately repeating a chemical service.SKIN TREATMENTS & AFTERCARESkin treatments are selected and performed having regard to the information provided during consultation and the condition of the client's skin at the time of treatment.Individual responses to professional skin treatments vary.Depending on the treatment performed, clients may experience temporary effects including redness, warmth, dryness, tightness, sensitivity or visible skin shedding. The specific aftercare required will depend upon the treatment performed.Clients must follow any instructions provided by their skin therapist, including where applicable instructions relating to:• cleansing;• moisturising;• sun protection;• active skincare;• exfoliation;• retinoids;• heat;• steam;• exercise;• swimming;• makeup; and• picking or rubbing treated skin.Clients must not recommence restricted active skincare or other treatments earlier than advised.Where a client uses products or undergoes another treatment contrary to the aftercare provided, this may alter the result or increase the risk of irritation.
TREATMENT RESULTS & INDIVIDUAL VARIATIONAll treatments are performed using professional techniques, products and protocols selected having regard to the individual client and information available to us at the time of treatment. However, beauty treatments do not produce identical results for every person. As discussed during consultation and through our treatment and aftercare information, results and longevity may be affected by factors including:• genetics;• skin type;• skin oil production;• skin cell turnover;• hair type;• hair condition;• porosity;• natural hair growth cycle;• underlying skin or hair conditions;• hormones;• medications;• previous chemical processing;• skincare;• makeup;• cleansing;• lifestyle;• environmental exposure;• water;• heat;• steam;• perspiration;• friction;• products used after treatment; and• adherence to aftercare.Where Miller Lane Aesthetics advertises or communicates an expected treatment longevity, this represents an expected range or maximum potential longevity rather than a guaranteed minimum result for every client, unless we expressly state otherwise. An individual's skin or hair retaining a temporary treatment result for less than the maximum advertised period does not, by itself, establish that the treatment has been performed incorrectly.GENERAL AFTERCAREClients are responsible for following all aftercare instructions provided before, during or following their treatment.Aftercare forms an important part of protecting the treatment result and maintaining the condition of the treated skin and/or hair.Failure to follow prescribed aftercare may:• reduce treatment longevity;• cause premature fading;• alter the appearance of the treatment;• compromise chemically treated hair;• irritate treated skin; or• otherwise contribute to an unwanted outcome.Where a treatment concern was caused or materially contributed to by failure to follow aftercare, a complimentary adjustment may not be appropriate.Aftercare requirements differ between treatments.Where specific instructions are provided by your artist for your treatment, those instructions take precedence over general information contained in these Terms.TREATMENT RISKS & LIABILITYBeauty, lash, brow and skin treatments involve individual biological responses and some outcomes cannot be predicted with certainty.By proceeding with a treatment, you acknowledge that:• results vary between individuals;• temporary treatments naturally change and fade over time;• individual sensitivities can exist;• aftercare can materially affect results; and• no specific longevity or result is guaranteed unless expressly stated. To the extent permitted by law, Miller Lane Aesthetics will not be responsible for an outcome to the extent that the outcome was caused or materially contributed to by:• inaccurate consultation information;• withheld relevant information;• failure to disclose medications, allergies, skincare or health information;• failure to follow prescribed aftercare;• actions taken by the client following treatment;• products used following treatment;• another treatment performed following the appointment; or• the acts or omissions of a third party.Nothing in this section excludes, restricts or modifies liability, consumer guarantees or other rights where doing so would be unlawful.
TREATMENT CONCERNS & COMPLIMENTARY ADJUSTMENTSWe encourage clients to contact us promptly where they have a concern regarding the immediate aesthetic result of a treatment.Prompt contact allows Miller Lane Aesthetics to assess the treatment while the original result remains reasonably representative of the service performed.24-hour notification periodAny concern regarding the immediate aesthetic result of a treatment must be reported to Miller Lane Aesthetics within 24 hours of the appointment to be considered under our complimentary adjustment policy.Where a concern becomes apparent during this period, clients should contact the studio when they first become aware of it rather than waiting until a later date.Concerns may be reported at any time by email or SMS. Where the 24-hour period falls wholly or partly on a day the studio is closed, a concern reported within 24 hours of the appointment will be treated as reported in time and will be responded to on our next trading day.Photographs are requiredThe initial concern must be accompanied by clear photographs of the treatment area.Photographs should:• be taken in clear or natural lighting;• clearly show the entire treatment area;• be unfiltered;• be unedited; and• accurately represent the concern being reported.Photographs allow our team to assess the treatment result and determine the appropriate next step.Where photographs do not clearly show the concern, additional photographs may be requested.AssessmentBefore determining whether an adjustment is appropriate, Miller Lane Aesthetics may reasonably request:• additional photographs;• information about when the concern first became apparent;• information about the client's activities after treatment;• details of aftercare followed;• details of products used following treatment;• information about exposure to water, heat, steam or perspiration;• details of skincare, makeup or cleansing products used; and/or• attendance at the studio for an in-person assessment.Clients are expected to reasonably cooperate with this assessment process.Complimentary adjustments are not automaticReporting a concern within 24 hours does not automatically entitle a client to a complimentary treatment, repeat service or refund. Each concern will be assessed individually having regard to:• the treatment performed;• consultation information;• treatment records;• photographs;• the condition of the skin or hair;• individual client characteristics;• prescribed aftercare;• aftercare actually followed;• products or treatments used following the appointment; and• any other relevant circumstances.Where Miller Lane Aesthetics determines that a complimentary adjustment is appropriate, the nature and timing of the adjustment will be determined having regard to the concern, treatment performed and the safety and condition of the client's skin or hair.A chemical treatment cannot necessarily be repeated immediately.Where reprocessing could compromise the skin, brow hair or lashes, Miller Lane Aesthetics may require an appropriate recovery period before further treatment is performed.Concerns raised after 24 hoursRequests made more than 24 hours after an appointment will not ordinarily be eligible for a complimentary adjustment under this policy. As time passes following treatment, the original result may be affected by normal fading, cleansing, skin cell turnover, hair growth, skincare, makeup, lifestyle, environmental exposure, water, heat, steam, perspiration, friction and other external factors. This can prevent Miller Lane Aesthetics from reliably assessing:• the immediate result of the service;• when any change occurred;• what caused the change; and• whether the treatment itself requires adjustment. The 24-hour timeframe applies to Miller Lane Aesthetics' complimentary adjustment policy only. Adverse reactions and health concernsThe 24-hour complimentary adjustment period does not prevent a client from contacting us about a health or safety concern that becomes apparent later.Any suspected adverse reaction should be reported to Miller Lane Aesthetics as soon as reasonably practicable.Where symptoms are severe, rapidly worsening or otherwise require urgent attention, clients should seek appropriate medical care rather than waiting for a response from the studio.
CHANGE OF MIND & PERSONAL PREFERENCEMiller Lane Aesthetics does not provide complimentary repeat treatments, adjustments or refunds solely because:• a client changes their mind after treatment;• a client later decides they would prefer a different colour, shape, style or aesthetic where the service was performed consistently with the consultation;• normal fading occurs;• a temporary treatment does not remain visible for the maximum advertised longevity;• individual skin or hair characteristics affect treatment longevity;• the client's natural hair growth cycle affects the appearance of the result;• aftercare has not been followed; or• circumstances outside Miller Lane Aesthetics' reasonable control have caused or materially contributed to the outcome.Where a client has a specific event, required longevity period or particular outcome in mind, this must be discussed with the artist before the treatment is performed.Temporary beauty treatments are affected by individual biological and lifestyle factors.Miller Lane Aesthetics does not guarantee that a temporary treatment result will remain unchanged until a particular future date or event unless such a result has been expressly guaranteed by us.REFUNDS, REMEDIES & AUSTRALIAN CONSUMER LAWMiller Lane Aesthetics does not provide refunds for simple change of mind or personal preference where a service has been properly supplied. Depending upon the nature of the issue and the rights available under the Australian Consumer Law, a remedy may include rectifying the treatment, repeating part of a service, refunding an applicable amount or another remedy required by law.Where the issue is minor and can appropriately be remedied, Miller Lane Aesthetics may be entitled to an opportunity to rectify the issue within a reasonable time.RETAIL PRODUCTSMiller Lane Aesthetics does not accept returns or exchanges of retail products for change of mind, particularly where products have been opened or used. This does not affect any rights or remedies available to you where a product is faulty, unsafe, incorrectly described or otherwise fails to comply with an applicable consumer guarantee.PAYMENT & PRICINGFull payment is due at the time the service is provided.Payments are processed through our approved payment systems, including Timely POS and TimelyPay.Current service pricing is displayed through our booking system. All prices are in Australian dollars and include GST where applicable.
